Terms of Use
The short version
- Commit Pro is a subscription billed by Apple. It renews automatically until you cancel.
- Cancel at least 24 hours before a trial or period ends to avoid the next charge.
- Commit gives fitness estimates, not medical advice. Check with a doctor before big changes.
- Your logs and photos are yours. You can delete them, and your account, anytime.
Agreement
These Terms of Use are an agreement between you and EdithStack Inc (“Commit”, “we”, “us”) for the Commit iPhone app and the website at trycommit.io (the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you don’t agree, don’t use the Service.
Who can use Commit
You must be at least 13 years old. If you’re under 18 (or the age of majority where you live), you need a parent or guardian’s permission. You must be able to form a binding contract and not be barred from using the Service under applicable law.
Your account
You sign in with Apple, Google or email. Keep your account secure and tell us if you think someone else has accessed it. You’re responsible for activity on your account. You can delete your account at any time in Settings › Account.
Subscriptions and free trials
- Commit Pro is offered as an auto-renewing subscription, currently $39.99 per year or $9.99 per month in the US. Prices may vary by country and are shown in the app before you buy.
- Free trial. New subscribers may get a 3-day free trial. Unless you cancel at least 24 hours before the trial ends, your subscription starts and your Apple ID is charged.
- Billing. Payment is charged to your Apple ID at confirmation of purchase (or when the trial ends). Your subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period.
- Cancelling. Manage or cancel in your iPhone’s Settings › Apple ID › Subscriptions. Cancelling stops future renewals. You keep access until the end of the period you paid for.
- Refunds are handled by Apple under its policies. Request one at reportaproblem.apple.com.
- Price changes. We’ll give you notice before any price increase, as required by Apple and the law.
- Deleting your account doesn’t cancel your subscription. Cancel it through Apple first.
Health and fitness disclaimer
Commit is not medical advice. It provides general fitness and nutrition information and estimates. It doesn’t diagnose, treat or prevent any condition.
Talk to a doctor before starting a new diet or exercise program, especially if you’re pregnant, have a medical condition, take medication, or have a history of disordered eating. Stop exercising and get medical help if you feel pain, dizziness or shortness of breath.
Calorie, macro and nutrition estimates (including AI estimates from photos), strength levels, starting weights and projected goal dates are approximations and may be inaccurate. You’re responsible for how you use them. Lifting weights carries a risk of injury. Use proper form and a spotter where appropriate.
Your content
You keep ownership of the meals, photos, workouts and other content you add (“Your Content”). You give us a limited licence to host, store, process and display Your Content only to run and improve the Service for you, including sending meal photos and descriptions to our AI provider for nutrition estimates. This licence ends when you delete the content or your account, except for copies in backups that are overwritten on our normal schedule.
Only upload content you have the right to share, and don’t upload anything illegal or harmful.
Acceptable use
Don’t misuse the Service. For example, don’t:
- Break the law or infringe anyone’s rights.
- Reverse engineer, scrape or interfere with the Service or its security.
- Use bots or automated means to access the Service, or resell it.
- Upload malware or content that is unlawful, hateful or sexually explicit.
Our intellectual property
The Service, including its design, software, the Commit name and logo, is owned by us and protected by law. We give you a personal, non-transferable, non-exclusive, revocable licence to use the app on Apple devices you own or control, as permitted by the App Store Usage Rules.
Third-party services
Commit works with services we don’t control, such as Apple Health, Sign in with Apple, Google Sign-In and the App Store. Their own terms and privacy policies apply to your use of them.
Ending your use
You can stop using Commit and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these Terms or if we must for legal reasons. If we discontinue the Service, we’ll give reasonable notice where we can.
Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise the Service will be uninterrupted, error-free, or that you will reach any particular result.
Limitation of liability
To the fullest extent permitted by law, Commit will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid for the Service in the 12 months before the claim or US $50.
Some places don’t allow these limits, so they may not fully apply to you. Nothing in these Terms limits rights you have under consumer protection laws that can’t be waived.
Indemnity
If you break these Terms or the law and someone brings a claim against us because of it, you agree to cover our reasonable costs and losses from that claim, to the extent allowed by law.
Governing law and disputes
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. Before filing a claim, please email support@trycommit.io so we can try to resolve it informally. Any dispute that isn’t resolved will be handled in the state or federal courts located in Texas, unless your local consumer law gives you the right to bring it where you live.
Apple App Store terms
If you downloaded Commit from the Apple App Store, you and we acknowledge that:
- These Terms are between you and us only, not Apple, and we, not Apple, are solely responsible for the app and its content.
- Your licence to use the app is limited to Apple-branded products you own or control, as permitted by the App Store Usage Rules.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to meet an applicable warranty, you may notify Apple, and Apple will refund the app’s purchase price (if any). Apple has no other warranty obligation, and any other claims, losses or costs from a failure to meet a warranty are our responsibility to the extent not disclaimed.
- We, not Apple, are responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
- If a third party claims the app infringes its intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging the claim.
- You confirm you’re not located in a country subject to a US Government embargo or designated as “terrorist supporting”, and you’re not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Changes to these Terms
We may update these Terms. If a change is material, we’ll tell you in the app before it takes effect. Continuing to use Commit after that means you accept the updated Terms.
